TERMS AND CONDITIONS FOR USE AND ACCESS OF THE CYBER MEDICAL COLLEGE WEBSITE

The use of and access to pages of this website operated by the Cyber Medical College ("CMC") is subject to the terms and conditions ("Terms") set out below. Please read and accept these Terms before accessing the CMC Website ("Website"). By using or accessing the Website or any part thereof you agree to be bound by the following terms and conditions.

1 COPYRIGHT

(c)Cyber Medical College 2001. The copyright in the Website is owned by CMC and protected by United Kingdom and International copyright laws. Any party using or accessing the Website ("Visitor") is entitled to copy any such information for their own personal use but may not re-publish, store or re-produce any such information in any manner, including without limitation electronic reproduction by "uploading" or "downloading", without the prior written consent of CMC. Any unauthorised downloading, re-transmission or other copying or modification of any of the contents of the Website may be in breach of statutory or common law rights which could be the subject of legal action. CMC disclaim all liability which may result from any unauthorised reproduction or use of the information on the Website. All rights not expressly granted are reserved by CMC.

2 SECURITY OF PERSONAL DATA - PRIVACY POLICY

Objectives

CMC is an e-learning and information portal set up to encourage the sharing of resources for healthcare education using the Internet. CMC is non commercial, non-profit making organisation providing an information service to all parties working or involved in healthcare to promote the dissemination of medical knowledge globally including remote and rural communities and developing nations. In order to provide the most efficient service CMC needs to collect certain personal information from Visitors through the use of enquiry and registration forms and when Visitors communicate with CMC by e-mail.

As the Internet is not a secure medium of communication CMC cannot guarantee the security of any information which any Visitor inputs on the Website. CMC is not and will not be responsible for any damages any Visitor may suffer as a result of the loss of confidentiality of any such information.

Despite the non-secure nature of the Internet CMC takes the privacy of Visitors seriously and is committed to safeguarding the privacy of all Visitors.

Information Collected

The e-mail address of Visitors will be collected if Visitors:

* voluntarily complete an enquiry/registration/speciality request form;

* post messages in any of the Forums accessible on or through the Website;

* communicate directly with CMC by e-mail.

CMC also collect information automatically regarding the specific pages within the Website which Visitors access which information includes demographic data and browsing patterns. This Information is only used in aggregate form.

Use of Personal Information

CMC process personal information collected via the Website:

* for internal audit purposes;

* to help improve the content of the Website and the service CMC offers to Visitors;

* to provide Visitors with information regarding updates or additional services available on or through the Website;

If you do not wish to receive information via e-mail from CMC in relation to any updates or additional services available on or through the Website please either tick the appropriate box on the enquiry/registration/speciality form or contact CMC by e-mail at or by telephone or by fax .

Disclosure of Personal Information

Any personal information collected by CMC via the Website will not be passed to any third parties including without limitation commercial organisations, employers and regulating authorities.

Use of Cookies

CMC use "cookies" to identify Visitors but only to determine whether (1) the Visitor has previously visited the Website; (2) these Terms have been accepted by the Visitor; and (3) the Visitor is registered with CMC and wishes to by-pass the registration process.

A "cookie" is a software device which identifies certain Visitors as noted above each time such a Visitor returns to the Website and allows CMC to build up a demographic profile of that Visitor in order to provide a personalised service.

The Website will still operate if a Visitor wishes to prevent the use of "cookies" but in such circumstances it is the responsibility of the Visitor to disable the "cookies".

Security

The Website has been designed to protect the privacy of Visitors and any personal information collected by CMC. Such personal information is protected by industry standard physical and electronic security systems.

CMC will hold personal information only for as long as is reasonably necessary to provide the most efficient service to Visitors.

3 COMMUNITY FORUMS

The Website shall include bulletin boards and discussion groups ("Forums"). These Forums will (I) provide feedback to CMC; and (ii) allow interaction between CMC and Visitors.

Rules

CMC can not control the information or material posted in or to the Forums by Visitors ("Messages"), but CMC reserves the right, which it can exercise at its sole discretion and without prior notice to delete, move or edit the Messages and terminate any Visitor's access to and use of the Forums.

By posting a Message in a Forum a Visitor waives any moral rights which he/she may have with regard to the Message.

Each Visitor is wholly responsible and liable for the content of any Message which that Visitor posts in a Forum.

Visitors acknowledge and agree to strictly comply with the rules set by CMC in relation to the posting of Messages in a Forum ("Rules").

Visitors must not:

* post, link to or otherwise publish any Messages containing any form of advertising or promotion for goods and services or any chain Messages or "spam";

* post, link to or otherwise publish any Messages which contain any confidential information of or about a third party;

* post, link to or otherwise publish any Messages that are unlawful, threatening, abusive, libellous, indecent, infringe copyright or any other rights of any third party or which contain any form of illegal content;

* disguise the origin of any Messages;

* impersonate any third party or misrepresent any affiliation to any third party;

* post, link to or otherwise publish any Messages unrelated to a particular Forum or the topic/subject of a particular Forum;

* post, link to or transmit any Messages that contain software viruses, files or codes designed to interrupt, destroy or limit the functionality of the Website or any computer software equipment;

* collect or store other Visitors' personal data;

* restrict or inhibit any other Visitor from using any Forum.

When submitting Messages to any Forum the Visitor agrees to indemnify and hold harmless CMC from all losses, damage, costs and expenses (including legal expenses) arising out of any Messages posted or published by the Visitor on the Website.

General

The Forums contain Messages submitted by Visitors over which CMC has no control and as a result CMC cannot guarantee the accuracy or integrity or quality of any Messages. Some Visitors may breach the Rules and post Messages that are misleading, untrue or offensive.

Visitors must bear all risk in relation to the use of any Forum and should not rely on any Messages in making (or not making) any specific decision or in taking (or not taking) any specific course of action.

By submitting a Message to any Forum, the Visitor is granting CMC a perpetual, royalty free, non-exclusive licence to reproduce, modify, translate, make available, distribute and sub-licence the Message in whole or in part and in any form.

CMC reserves the right to contact a Visitor by e-mail with regard to the Visitor's use of the Forums.

If any Visitor believes that a Message infringes his/her legal right(s), that Visitor should notify CMC immediately by contacting CMC by e-mail at or by telephone or by fax .

4 TRADE NAMES

Certain names, words, titles, phrases, logos, icons, graphics and designs displayed on the Website constitute trade names or registered or unregistered trade marks of CMC. The display of any trade names or registered or unregistered trade marks on the Website does not imply any licence has been granted to any third party in respect of the same. All rights not expressly granted are reserved by CMC.

5 LIABILITY FOR DAMAGES

CMC shall not be liable for any direct or indirect, special, incidental or consequential damages including any loss of profits, business, revenue or goodwill arising from the use of or access to or inability to use or access, interruption or availability of the Website, its operation or transmission, computer viruses, loss of data or otherwise in respect of its use or the downloading or use of any software, including pdf files, made available by CMC on the Website. Any Visitor using or accessing the Website shall indemnify CMC from and against all claims, expenses, losses or liabilities (including professional fees and expenses) in connection with any claim by a third party relating to the use or downloading of the software or data or arising from such use or downloading.

CMC is not responsible for invalid destinations or transmission errors in, corruption of, or the security of information carried over telecommunications carriers' or other providers' facilities. CMC has no liability for faulty or interrupted communication links.

6 WARRANTIES

The content displayed on the Website ("Content") provided by CMC is for general information purposes only and is directed primarily at all parties working or involved in healthcare. The Content is not intended to address any specific individual requirement and does not constitute any form of specific individual advice or recommendation. The Content is not a substitute for medical consultation with a registered medical practitioner or qualified medical professional.

In relation to Visitors who are not healthcare professionals appropriate medical advice must be obtained from a registered medical practitioner or qualified medial professional and the Content displayed in this Website must not be relied upon.

Because of the variety of sources from which CMC obtains the Content including text, graphics, hypertext links or other items the Content is provided on an "AS IS" basis excluding any warranty whatsoever, expressed or implied, including, but not limited to, warranties of satisfactory quality, fitness for any particular purpose or freedom from computer viruses. CMC excludes any liability for (i) any errors in or omissions from the Content and (ii) any other websites linked to or from the Website.

CMC excludes any warranty that the Website will be error free, free of viruses or uninterrupted.

7 LINKS TO OTHER WEBSITES

CMC accepts no responsibility or liability in respect of any material displayed on any third party websites which are not under its control.

8 ACCURACY OF CONTENT ON THE WEBSITE

The majority of the Content is provided by third parties or consists of hypertext links to third party websites.

The Content is believed to be reliable when displayed. CMC cannot guarantee that the Content will be accurate, complete and current at all times. All Content is subject to modification from time to time without notice.

As acknowledged by the Visitor the Content is primarily provided by third parties and CMC has no control over or liability for any such Content.

9 CHANGES TO THE TERMS

CMC reserves the right to make changes to any part of the Website and due to its policy of updating and improving the Website CMC may wish to change the Terms. CMC reserves the right to modify these Terms relating to the use of and access to the Website without prior notice. The amended Terms shall become effective immediately upon the posting of the amended Terms on the Website and the use of the Website by any Visitor on or after any such effective date shall constitute acceptance of such amended Terms.

10 GOVERNING LAW

The Terms shall be governed by and construed in accordance with the laws of Scotland and if any Visitor intends to take legal action in relation the Terms and/or the Website such Visitor agrees that the Scottish courts shall have exclusive jurisdiction.

11 GENERAL

If any provision of the Terms is found to be invalid the validity of that provision shall not affect the validity of the remaining provisions of the Terms which shall remain in full force and effect.

No Visitor may assign, sub-licence or otherwise transfer any of their rights under the Terms. If CMC or any Visitor fails to exercise any right or remedy available under the Terms such failure does not constitute a waiver of that right or remedy.

The Headings in the Terms are for convenience only and will have no legal meaning or effect.
